Introduction
These Terms and Conditions ("Terms") govern the relationship between the operator of the POMAIA application and the user of the application ("User").
The application is operated by: Ondřej Hoos, Registration No.: 05467390, registered office at Školská 660/3, 110 00, Praha 1 - Nové Město, Czech Republic (hereinafter "Operator").
By downloading or using POMAIA, you agree to these Terms. If you do not agree, please do not use the application.
Description of Service
POMAIA is a mobile application designed for tracking the menstrual cycle and symptoms associated with Polycystic Ovary Syndrome (PCOS). The application serves exclusively as an informational and wellness tool and does not provide medical advice, diagnoses, or treatment.
Key features of the application include:
- Menstrual cycle, ovulation, and related symptom tracking
- Logging mood, sleep, body measurements, cervical mucus, and other indicators
- Medication management and reminders (local push notifications)
- Generation of PDF reports for healthcare providers (locally on device)
- Data backup and export in JSON format (with optional password encryption)
- Educational articles about PCOS and healthy lifestyle (offline, bundled in app)
- Personalized recommendations and insights based on your logged data
- Home screen widgets (cycle day, overviews)
Health Disclaimer
IMPORTANT: POMAIA is not a medical device within the meaning of EU MDR 2017/745, nor a healthcare application within the meaning of applicable legislation. The application falls under the general wellness tool category and is not intended for the diagnosis, treatment, mitigation, or prevention of any disease or health condition.
Information provided by the app, including educational articles, recommendations, and insights, does not substitute professional medical care. Always consult your doctor or other healthcare professional regarding your health condition.
Cycle and ovulation predictions are estimates based on statistical models and may not be accurate. The app MUST NOT be used as a contraceptive method.
User Account and Access
The app does not require registration or account creation. All your data is stored locally on your device in an encrypted database.
The app offers optional biometric security (Face ID, Touch ID, PIN) to protect access to your data. You are responsible for the security of your device and chosen security method.
You can back up your data to a JSON file (with optional password encryption) and import it to another device. The Operator is not liable for data loss if you do not use the backup feature.
Subscription and Payments
POMAIA offers basic features for free and premium features through a subscription (Pomaia Premium). The following conditions apply:
- Subscriptions are processed through the App Store (Apple) or Google Play (Google) in accordance with their terms
- Subscription management is technically provided by RevenueCat Inc. — this service processes only anonymous transaction identifiers, not payment details
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Subscriptions can be cancelled in App Store or Google Play settings
- Subscription pricing is displayed in the app prior to purchase
- Refunds are governed by the policies of the respective platform (Apple / Google)
Limitation of Liability
The Operator is not liable for:
- Loss of data caused by technical issues, device loss, theft, or damage
- Any decision made by the User based on information, recommendations, or insights from the app
- Health consequences arising from use or non-use of the app
- Inaccuracies in cycle or ovulation predictions or any recommendations
- Service interruptions or unavailability due to causes beyond the Operator's control
Warranty Disclaimer (for US Users)
FOR US USERS: THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
Intellectual Property
All content in POMAIA, including design, graphics, text, educational articles, and software, is the intellectual property of the Operator or respective licensors. You may not copy, distribute, or otherwise use the app or its content beyond normal use without the Operator's written consent.
Acceptable Use
The User agrees not to use the application for:
- Any unlawful purpose
- Attempting to disrupt, reverse engineer, or damage the application or its servers
- Any conduct that could harm other users or the Operator
Termination
The Operator reserves the right to suspend or terminate access to the application in case of a breach of these Terms.
The User may terminate access at any time by uninstalling the application. Upon uninstallation, all locally stored data will be deleted (subject to your device settings). We recommend exporting your data using the backup feature before uninstalling.
Changes to Terms
The Operator reserves the right to modify these Terms at any time. You will be notified of material changes through the app. Continued use of the app after notification of changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.
For EU users: This does not affect the protection afforded to you by the law of your country of residence from which cannot be derogated by agreement (see Art. 6(2) of the Rome I Regulation). Consumer disputes may also be resolved through the ODR platform: https://ec.europa.eu/consumers/odr
Age Restriction
The application is intended for persons aged 16 or older (within the EU) or 13 or older (in the US, in accordance with COPPA). If you have not reached the required age, do not use the application.
